Although there are no certification requirements in most states, strict state-specific Micropigmentation and tattoo regulations have been put in place throughout the country to assure the safety and well-being of the public. Below you will find a listing of permanent makeup laws by state. Whether you are a potential client or are interested in a career as a Certified Permanent Cosmetic Professional (CPCP),  most importantly, make sure you become familiar with these regulations in your state or region.

PERMANENT MAKEUP LAWS BY STATE: A

State: Alabama  
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, and facility inspection handled by the State Department Of Public Health. Additionally, cosmetic tattoo regulations listed here. A blood-borne pathogen training program is required. Any tattooing of a minor prohibited. State-specific tattoo laws are here.

State:  Alaska 
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Department Of Commerce, Community, and Economic Development, and licensing here. Consequently, cosmetic tattoo restrictions include no tattooing of a minor without the written consent of a parent or guardian. Permission must be kept on file for at least three years. SB34 was passed and information on cosmetic tattooing found here.  

State:  Arizona  
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Arizona State Board Of Cosmetology with requirements found here. Statutes handled additionally by the Arizona State Legislature are here. Permanent Makeup regulated separately from tattooing. Consequently, It is unlawful for a person to engage in the business of Micropigmentation out of a temporary facility, home, or mobile unit. Consequently, any tattooing of minors prohibited and considered a felony offense.  

State:  Arkansas 
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Arkansas Department Of Health. Additionally, licensing and certification are required to apply for permanent cosmetics. Permit requirements found here. Permanent makeup and body tattooing are regulated separately. PERMANENT MAKEUP LAWS: C

State:  California
Permanent makeup laws by state And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Firstly, oversight handled by the California Department of Public Health. AB 186 requires that facilitiesbe registered, inspected, and permitted by their specific County Environmental Health Dept. Safety standards and specific bill information found here. Any tattooing of a minor prohibited. Additionally, State-specific tattoo laws found here

State: Colorado   
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Colorado Department Of Public Health And Environment, and additionally the State Board of Cosmetology. Permanent Makeup regulated separately from tattooing. Consequently, Parental consent is mandatory for tattooing a minor.  

State: Connecticut
Permanent Makeup And Tattoos Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Department Of Public Health. More specifically, regulations for tattoo technicians found here.  
Chemical injection for tattoo removal is illegal. Additionally, specialists must keep records for at least two years. In conclusion, minors required to have written permission to have a tattoo procedure by a parent or guardian.

State: Louisiana

State: Maine
Permanent Makeup And Tattoos Are: Regulated by the state.

Permanent Makeup And Tattoos Are: NOT very well regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Maryland Board Of Cosmetologists. Permanent makeup application is illegal and prohibited in beauty salons. Subsequently, any tattooing of a minor prohibited without the consent of a parent or guardian. State: Massachusetts
Permanent Makeup And Tattoos Are: Regulated by the state. Massachusetts is an example of what states regulate tattoo facilities. Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Massachusetts Board Of Cosmetology. Consequently, Micropigmentation and permanent makeup are classified as underbody art. Each local regulates separately through the Department Of Health And Human Services.  Certification required by the American Academy Of Micropigmentation. State: Michigan

State: Nebraska

State: Nevada
Permanent Makeup And Tattoos Are: NOT regulated by the state government.
Although the Department Of Health And Human Services and the Nevada Division Of Public And Behavioral Health oversee certain counties, there are no responsibilities to the regulation of cosmetic tattooing. The various districts such as The Southern Nevada Health District,  and Washoe County, regulate themselves through local boards of health. Moreover, other legislative information found in the Nevada Legislature. Specialists must be licensed in the city that they live.  Strict regulations apply in many of these districts, so, in short, be sure to contact these local health departments if you have specific questions or concerns. State: New Hampshire

Permanent Makeup And Tattoos Are: NOT regulated by the state government.
Very little regulation exists for permanent makeup by the state government in New Mexico. Statutes are focused mostly on animals over tattoo regulations for human beings. Consequently, licensing required and training is highly recommended. Any specific questions or concerns, make sure to make contact your regional Department of Health. Additionally, it is prohibited to tattoo a minor.

State: New York

Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the North Carolina Department Of Health And Human Services. StateNorth Dakota
Permanent Makeup And Tattoos Are: NOT regulated by the state government.
Additionally, licensing, facility inspection, and costs, are moderately overseen by the North Dakota Department Of Health. Attention is more focused on tattoo equipment. Specific county licensing requirements do exist, however, so make sure to check them. PERMANENT MAKEUP LAWS: O

State: Ohio

State: Pennsylvania
Permanent Makeup And Tattoos Are: NOT regulated by the state government.
There are currently no state health regulations in place for permanent makeup in Pennsylvania. As a result, licensing, facility inspection, and costs, are technically the responsibility of the Pennsylvania Department Of Health . Oversight primarily handled by the State Board Of Cosmetology. Licensing information found here. The cosmetic specialist must adhere to the Micropigmentation Law of 2001. Permanent makeup must be performed by a licensed specialist and NOT in a salon. PERMANENT MAKEUP LAWS BY STATE: V

State: Vermont
