Although certification is not required in most states,  strict state specific Micropigmentation and tattoo regulations have been put in place throughout the country to assure the safety and well being of the public.  Whether you are a potential client, or are interested in a career as a Certified Permanent Cosmetic Professional (CPCP),  make sure you become familiar with these regulations in your state or region.

State:  Alaska 
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Department Of Commerce, Community, and Economic Development, and licensing here. Cosmetic tattoo restrictions include no tattooing of a minor without written consent of parent or guardian. Permission must be kept on file for at least three years. SB34 was passed and information on cosmetic tattooing can be found here.  

 

State:  Arizona  
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Arizona State Board Of Cosmetology with requirements found here. Statutes also handled by the Arizona State Legislature found here. Permanent Makeup is regulated separately from tattooing.  It is unlawful for a person to engage in the business of Micropigmentation out of a temporary facility, home, or mobile unit. Any tattooing of minors is prohibited and is considered a felony offense. State specific tattoo laws can be found here.  

 

State:  Arkansas 
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Arkansas Department Of Health. Licensing and certification are required to apply permanent cosmetics. Permit requirements can be found here. Permanent makeup and body tattooing are regulated separately. Rules and regulations can be found here. State:  California
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight handled by the California Department of Public Health. AB 186 requires that facilities must be registered, inspected, and permitted by their specific County Environmental Health Dept. State: Colorado   
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Colorado Department Of Public Health And Environment, and the State Board of Cosmetology. Permanent Makeup is regulated separately from tattooing. Parental consent is mandatory for tattooing a minor. State specific tattoo laws can be found here.  

 

State: Connecticut
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Department Of Public Health. More specifically, regulations for tattoo technicians can be found here.  
Chemical injection for tattoo removal is illegal. Specialists must keep records for at least two years. Minors are required to have written permission to have a tattoo procedure by a parent or guardian. State specific tattoo laws can be found here.  

 

State: Delaware

Requirement’s And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Delaware Department Of Health And Social Services. State:  Florida  
Permanent Makeup And tattoo’s Are: Regulated by the state.
Requirement’s And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Florida Department Of Health. State: Idaho 
Permanent Makeup And tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the State Legislature. Certificate of compliance is required. Parental consent is required for tattooing, branding and body piercing of any person under the age of eighteen (18) years. State: Louisiana

Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Maine Department of Health And Human Services. Micropigmentation and tattooing regulated separately and certification is required by the American Academy Of Micropigmentation.  Health inspection and license renewal information can be found here. State: Maryland
Permanent Makeup And Tattoo’s Are: NOT very well regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Maryland Board Of Cosmetologists. Permanent makeup application is illegal and prohibited in beauty salons. Any tattooing of a minor is prohibited without the consent of a parent or guardian. State specific tattoo laws can be found here. 

 

State: Massachusetts
Permanent Makeup And Tattoo’s Are: Regulated by the state.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Massachusetts Board Of Cosmetology. Micropigmentation and permanent makeup are classified under body art. Each local regulates separately  through the Department Of Health And Human Services.  Certification is required by the American Academy Of Micropigmentation. State: Michigan

State: Nevada
Permanent Makeup And Tattoo’s Are: NOT regulated by the state government.
Although the Department Of Health And Human Services and the Nevada Division Of Public And Behavioral Health oversees certain counties, there is no responsibilities to the regulation of cosmetic tattooing. The various districts such as The Southern Nevada Health District,  and Washoe County, regulate themselves through local boards of health. Other legislative information can be found from the Nevada Legislature. Specialists must be licensed in the city that they live.  Strict regulations apply in many of these districts, so be sure to contact these local health departments if you have specific questions or concerns. Any tattooing of a minor is prohibited. State specific tattoo laws can be found here. 

 

State: New Hampshire

State: New Jersey

Specifically, licensing and more general information on permanent makeup regulations can be found here and here. Certification for specialist is required by the American Academy Of Micropigmentation. Any tattooing of a minor is prohibited and a photo ID must be presented.

 

 

StateNew Mexico
Permanent Makeup And Tattoo’s Are: NOT regulated by the state government.
Very little regulation exists for permanent makeup by the state government in New Mexico. Statutes are focused mostly on animals over tattoo regulations for human beings. That said, licensing is required and training, is highly recommended. if you have any specific questions or concerns, make sure to make contact with your regional Department of Health. Any tattooing of a minor is prohibited.

 

 

State: New York

Permanent Makeup And Tattoo’s Are: Regulated by the state government.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the North Carolina Department Of Health And Human services. Licensing and more general information on permanent makeup regulations can be found here. Annual permit renewal is required. Any tattooing of a minor is a felony offense.

 

 

StateNorth Dakota
Permanent Makeup And Tattoo’s Are: NOT regulated by the state government.
Licensing, facility inspection, and costs, are moderately overseen by the North Dakota Department Of Health. Attention more focused on tattoo equipment. Specific county licensing requirements do exist so make sure to check them. State: Ohio

State: Pennsylvania
Permanent Makeup And Tattoo’s Are: NOT regulated by the state government.
There are currently no state health regulations in place for permanent makeup in Pennsylvania. Although licensing, facility inspection, and costs, are technically the responsibility of the Pennsylvania Department Of Health, oversight is primarily handled by the State Board Of Cosmetology. and licensing information can be found here. Cosmetic specialist must adhere to the Micropigmentation Law of 2001. Permanent makeup must be performed by a licensed specialist and NOT in a salon. Any tattooing of a minor is prohibited.

 

 

State: Rhode Island

Permanent Makeup And Tattoo’s Are: NOT regulated by the state government.
Only certain counties regulate permanent makeup, so be sure to check with your county health department to get information on oversight, licensing, facility inspection, and costs. Any tattooing of a minor is prohibited.

 

State: Vermont
Permanent Makeup And Tattoo’s Are: Regulated by the state government.
Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Vermont Secretary Of State. Licensing, sanitation standards,  and legislature information can be found here.  Three years experience required to apply permanent makeup. Any tattooing of a minor is prohibited.

 

StateVirginia

Requirement And/Or Regulation’s Include: Oversight, licensing, facility inspection, and costs, handled by the Virginia Department Of Professional And Occupational Regulation.
